J. J. Dudash -3- April 25, 2007 <br />during idle periods. Explosive and cap storage will be in accordance with <br />applicable regulations. <br />Rule 2.10 -Maps and Plans <br />9. DRMS: Please revise the pertinent maps to show the new permit boundary, as <br />required in Rule 2.10.1(3). As has been done in the past, the maps can be submitted <br />alter the adequacy review is finished but before a proposed decision is made. <br />BRL: BRL will submit the affected maps after the adequacy review is finished <br />and prior to the proposed decision. <br />Rule 4.02.6 - Blasting Signs and Rule 4.08 -Use of Explosives <br />10. DRMS: Because explosives will be used in the construction of the Hubbard Creek <br />vent shaft, Rule 4.02.6 and certain portions of Rule 4.08 will apply. Please provide the <br />details of the blasting plan and state which sections of the blasting rules and Section <br />2.05.3(6) of the Bowie No. 2 permit application are applicable to TR-47. The plan details <br />should include, but not be limited to, the anticipated maximum size of each blast, <br />approximate distances from the blast area to active and abandoned underground mines, <br />any required permits, certifications and record keeping, flyrock prevention safety <br />measures for the public and for any livestock, the county road closure plan and county <br />approval of the road closure, public warning signals and any required blasting notices. <br />BRL: A formal blasting plan will be drafted once a contractor is selected. There <br />is a blasting plan in the permit, pages 2.05-42 through 2.05-44 that will be <br />referenced as the plan is drafted. All record keeping requirements listed in the <br />permit will be followed except seismographic and air blast records. The size of <br />the blast will be greater than 5 pounds so blasting will be conducted according to <br />the schedule required by Rule 4.08.3. The approximate distance to Oxbow's <br />underground mining is 800 feet and the blasting will be within 540 feet of the <br />abandoned U S Steel workings. Section 2.05.3(a)(iii) addresses the safety <br />prevention measures for the public and livestock as well as the plan for Hubbard <br />Creek Road closure. The only approval required from the County is to notify <br />them prior to commencement of the blasting operation, and to use correct <br />signage. Please see the attached email from Ralph Clark (Delta County Road & <br />Bridge Foreman). A public notice similar to the one shown on permit page 2.05- <br />42 will be used for this blasting operation. Sections 2.05.3 (a)(iv through vii, <br />shown on pages 2.05-42 through 2.05-44) will apply and will be part of the <br />blasting plan once a contractor is selected and the plan is drafted. Signs will be <br />posted in accordance with Rule 4.02.6. <br />11. DRMS: In the Division's letter dated March 30, 2007, a copy of Oxbow Mining's <br />comment letter concerning TR-47 was mailed to BRL. In that letter, Oxbow commented <br />that they did not want any changes or limits to their access to conduct mining operations <br />due to proposed activities in TR-47.
