Following aze items of <br />concern which need to be addressed in order for the application to meet the minimum <br />requirements of the AcUMineral Rules and Regulations: <br />1. Exhibit C -are there any power and/or communication lines within 200 feet of the affected <br />land, especially in the northern part of the affected land boundary? 1f so, they must be <br />shown on one, or both, of the Exhibit maps (6.4.3(a)). Also, the owner's name, type of <br />structure and location of the structure(s) must be shown on the Exhibit maps (6.4.3(8)). <br />2. Rule 3.1.5 - Backfilling -will the backfilled material need to be compacted to ensure <br />that it will remain stable (3.1.5(2))? <br />3. Rule 3.1.5 -the applicant proposes to grade the reservoir slopes to 3:1 or less to provide <br />"the best protection for wave cut action on the reservoir shore." Actually, armoring the <br />shore slopes will provide the best protection from wave cut action. Normally, the west and <br />north facing slopes are armored. It is not necessazy to azmor the entire slope, only the <br />interval from a couple of feet above the anticipated high water line to a few feet below the <br />anticipated low water line need to be armored in order to achieve the best protection for <br />wave cut action. The applicant should include a plan to install the best wave erosion <br />protective system for the reservoir slopes to ensure they will remain stable during high <br />wind conditions. <br />4. Rule 3.1.6 -part of the proposed affected land will contain a water storage facility. How <br />will the facility be filled? How does the applicant propose to release water from the <br />facility? <br />5. Rule 3.1.6 -the applicant shall minimize disturbances to the prevailing hydrologic balance <br />of the affected land and of the surrounding area. Specifically, the applicant shall minimize <br />disturbances to all nearby water wells. Prior to disturbing any acreage in Phase 1 of the <br />proposed amended area, the applicant shall receive approval from the DMG of a plan that <br />
