4. Remove the shop building adjacent to Pit 4 and retopsoil and reseed <br />the shop and yard areas. Rockcastle will recontour the shop and yard area <br />fill pad as necessary to achieve approximate original contour criteria of <br />2 CCR 407-2, Rule 4.14.2 and 1.04(13). <br />5. Undertake such additional reclamation measures as necessary based <br />upon the results of engineering studies conducted by Rockcastle under § IV of <br />this Agreement. <br />6. The reclamation activities specified herein, will commence on or <br />about June 1, 1990. The reclamation activities specified herein will be <br />completed by October 31, 1990. The date of completion of reclamation shall be <br />extended by mutual agreement of the Division and Rockcastle if the reclamation <br />activities are delayed due to weather conditions or other circumstances beyond <br />the reasonable control of Rockcastle. <br />III. ROADS AND SEDIMENT PONDS -- The Division and Rockcastle agree: <br />1. The Division and Rockcastle agree that the Reclamation Plan <br />contemplates retention of these roads and that the surface landowner has <br />requested that these roads remain after site reclamation. Haul roads shall be <br />downgraded to a 20' width unless it is demonstrated that a larger width is <br />necessary to facilitate the approved postmining land use. <br />-4- <br />
