Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology (Division) has reviewed Seneca Coal Company's <br />second adequacy response letter received on July 1, 2004 for Technical Revision No. 25. <br />Based on this review, the Division has remaining comments and recommendations. <br />Byron Walker of the Division has raised concerns regarding slope stability at the Yoast <br />Mine and additional comments have been included as a result of his May 25, 2004 site <br />inspection. Additionally, the Division issued NOV CV-2004-002 on June 30, 2004 and <br />NOV CV-2003-006 on July 21, 2003 regarding erosion and sediment control issues and <br />for failure to retain sediment within disturbed areas. As a result of these violations and <br />further discussions within the Division, we are requesting that SCC update all pertinent <br />maps, exhibits and permit sections to incorporate the two large gullies (east of the North <br />Pit and lower Armand Draw) into the approved disturbance area boundaries. Please refer <br />to Comment 6 below. <br />Comment 1. <br />la. Response accepted. <br />lb. Response accepted, however, the various pit area references were included on <br />Exhibit 19-1A but were not added to Exhibit 12-1. <br />lc. SCC indicates in response to item li that Exhibit 19-1A has been re-designated as <br />19-1. This does not appear to be the case, the Backfill and Grading Plan has been <br />resubmitted as 19-1A. Please ensure that all references to the Backfill and <br />Grading Plan are correct and consistent whether they are 19-1 or 19-1A.
