Minutes, Rpril 22-23, 1992 <br />DRlaFT <br />Subject To Board Approval 31 <br />operator. He also requested that the maximum fine be imposed against <br />the operator, if found in violation. He answered questions and <br />discussed concerns with the Board. <br />In response to an inquiry from the Board, Ms. Nora Jacquez, an attorney <br />representing the Concerned Citizens of Costilla County and the People's <br />Alternative Resources, reiterated a concern listed in I_xhibit D that <br />independent monitoring be provided at the operator's expense. Ms. <br />Jacquez also discussed a desire that the community has input, regarding <br />modifications to the operator's permit. She and Ms. Sigmund answered <br />questions from the Board. Ms. Sigmund said the Conservancy District <br />disagreed, regarding some of the abatement requiremerts, with the <br />Division's consideration that they have been satisfied. <br />Ms. Maria Valdez, a resident of area and representative cf the People's <br />Alternative Energy Services, discussed the issue of compliance <br />monitoring, concerns with the environment and the possible impact of <br />the operation on the health and safety of the people of the area. She <br />discussed a list of requirements proposed by the People's Alternative <br />Energy Services. <br />Dr. Devon Pena, a professor of sociology and environmental studies at <br />the Colorado College, stated that he had been working the people of San <br />Luis for approximately 3 years on economic development issues, <br />sustainable agriculture and the operator's mining operation. He <br />discussed concerns, regarding the the failure of tie operator's <br />treatment system and the historic culture in the area. He suggested <br />the Board revoke the operator's permit, after remediation of <br />reclamation. <br />During a final statement on behalf of the operator, Mr. Massey stated <br />that the operator acknowledges the problems connected with the site. <br />He said the compliance plan presented by the Division an~i to which the <br />operator had committed could solve those problems. Mr. Massey said <br />that, at this time, the operator does not feel there is basis for <br />closing plant, but has committed to doing so if it preseits a risk to <br />health and safety. <br />The Director stated that the Division feels the appropriate actions <br />were taken when made aware of the problem at the site. However, he <br />said the Division recognizes, understands and shares the concerns <br />presented by the community. The Director stated that the Division has <br />put forth a lot of resources and is committed to resolving the <br />problem. He said the operator has been cooperative, since the problem <br />was identified. <br />
