~ DF~FT <br />Hioutes, April 2Z-23, 1992 30 <br />Subject To Board Approval <br />request. At this point, Board Member Stewart discussed her knowledge <br />of other cyanide treatment methods. Staff noted that the Division does <br />not disagree with the information provided by Dr. Hyatt. <br />Regarding this matter, Mr. frank Johnson Clarified that the operator <br />had submitted a technical revision which was approved by the Division. <br />He said the Division is requesting that the Board approve the list of <br />abatement requirements to which the operator has agreed. Mr. Johnson <br />said that the operator will eventually have to modify the permit to <br />include a new detoxification reclamation plan. <br />In response to a concern ~`rcm Ms. Sigmund, Board Member Cattany <br />suggested that the operator be required to achieve adequate cyanide <br />levels by the June 1992 Board Meeting and that the Staff be directed to <br />provide the Board with a preliminary evaluation on CyTox and the <br />operator's progress toward achieving compliance. Board Member Stewart <br />also suggested that a status report on each abatement item be provided <br />at the May 1992 Board Meeting. <br />Ms. Sigmund stated that the Board had approved the operator's permit <br />conditioned upon water court approval. She referenced the documents <br />attached to Exhibit C and said that an additional condition of that <br />approval, to which the operator had agreed, was the placement of 3 <br />lysimeters in the area, including testing and the forwarding of the <br />results to the Board, the Costilla County Conservancy District and a <br />neighbor. <br />Ms. Sigmund introduced Scott Metford, a certified professional <br />geologist, and said he haci testified at the water court hearing, <br />regarding ground water contamination concerns. Mr. Metford said that <br />because the mine is located rear the Rito Seco River, it might impacted. <br />Mr. Metford listed and discussed the following concerns: 1) lack of <br />reporting monitoring information, 2> modifications to the tailings <br />which Leave cyanide concentrations higher than 4.4, 3) affects the <br />operation might have on drinking water, 4) installation of lysimeters <br />and 5) leakage of the primary liner in the coilection pond. <br />Mr. Metford requested that the substantial changes to the monitoring <br />plan being planned be subject to public review and comment. He also <br />requested that the 3 lysimeters the operator installed be incorporated <br />into the monitoring plan. Mr. Metford answered questions from the <br />Board, specifically regarding cyanide testing and levels. <br />Ms. Sigmund introduced hlaclavio Gallegos, the Costilla County <br />Administrator. Mr. Gallegos presented EXHIBIT D, a copy of a <br />resolution from the Costilla. County Commissioners, addressing 8 issues, <br />in support of the efforts of the Costiita County Conservancy District. <br />He stated that Maclavio Martinez would provide responses, regarding the <br />resolution. <br />Mr. Martinez referenced the resolution and specifically discussed their <br />request that independent sample testing be provided and paid for by the <br />
