F, Suite 101 <br />Durengo, CO 81301 <br />Re: June 8, 1999 Ctizen Complaints Letter from <br />DMG Permit M~1-013, Conversion Application CN-02 <br />Dear Mr. Oswald: <br />Received <br />JUN 2 3 1999 <br />DH1ebn of~~ ~ ~ ~ °OY <br />Bill Oswald for Nichols Gravel Pit, <br />This letter is in response to your letter d June 8, 1999 regarding three written complaints received in your office <br />conoeming the approval d the Nichos Gravel Pit. Yau state: <br />'Enclosed are copies d flues written complaints whist our otTice received in regard to the above named application....At <br />least one d the iswes cted therein (graatduvater) is within the jurisdiction d this agency, and must therefore be <br />addressed to the satisfaction d this agency.' <br />I have been asked by the Nichols Gravel Pit owners to review and assess these complaints. In reviewing the three <br />letters, there are two complaints that relate to the water resource and groundwater systems d the area. I will review and <br />respond to the complaints as they have been presented. The first d these is item three d the complaints presented by <br />Mr. and Mrs. Ben Hayes. In his letter, Mr. Hayes states: <br />'3 -The reclamation plans Called for creation d a lake in the resulting pd, A well permit has been granted to <br />provide water for dust control throughout the 10-15 year operation d gravel pit, the well in the pit could possibly <br />effect the wells d the entire neighborhood also ground water diverted by the well coukd be hydraulically <br />connected to Plateau Creek which is a tributary d the Colorado River System, also may effect Bull Creek and <br />Coon Creek water flow into Plateau Creek ' <br />Mr. and Mrs. Paul Duzenadc state in their letter. <br />In No.3 [reference to attachment written by Concerned Mesa Citizen] he does not allude to the fad that <br />reclamation will nd be replanting twt drilling a watt and putting in a lake. Has the water table been checked to <br />see rf pulling water to fill a lake will have adverse affect on the surrounding well owners. We all have wells here <br />and at best get 5 gallons or kiss a minor along this area d I~ Rd. How large is this lake and will it cover the <br />entire area 13 years from now. <br />Concerning these complaints the following points are made: <br />Conoeming Mr. Hayes and Mr. Duzerlacks complaints d a lake construction: The redamaGon plans do <br />not call for any creation d any lake. This comment probably originated from local disa~ssion at the <br />local coffee strop as well as through inrtaccuracles distributed in the unsigned letter to neighbors under <br />the authorship d'concerrted Mesa Citizens'. In conversations with Mr. John Nichols, he stated that <br />this was an early thought in the preliminary discussions in family discussions, but readily abandoned <br />before any plans or current permitting process was initiated. This inaccurate idea was further <br />propagated by the local newspaper article titled 'Nichols Gravel Pit Aodies for Conversion (Plateau <br />Valley Times, April 28, 1999 page 1).
