Massey Page Teo (anu~rv ~9 1 X99 <br />However, I am infornied that the presentation that was given by BMR1 to tl:e <br />Colorado Mined Land Reclamation Board on Januarv 27, 1999, convinced the Board, <br />at least for now, that BMRI does intend to monitor, address, and ftr the problems <br />concerning the leak, and that BMRI is to committed to malting certain that affected <br />parties are fully informed ~c~th regard to the monitoring results and the resolution of <br />the leak problems. <br />On Mr. and Mrs. Cooper's behalf and in conforntance «ith Bi~iRI's <br />commitment to keep potentialh~ affected parties fully informed, I request that you <br />provide me with the follo~+~ng information: <br />1. What is the discharge rate of water and the nature of the cnntaminar.ts <br />]ealcing From the West Pit a- other locations on BMRI property? <br />2. Assuming that those discharge rates have fluctuated over time, please <br />state the range of fluctuation of discharge during the months of December, 1995, and <br />Januarv of 1999. <br />3. What has been done so far to collect and contain the seep discharge and <br />what are BMRI's plans and tirmetable Eor a permanent solution to the seep problem:' <br />What, if any, contaminants have been identified as having passed downstream, <br />underground or othencrise from the BMRI "containment" ponds? <br />=k. Have any other leaks Ueen discovered other than that from the "West <br />Pit", and if so what are the locations of those leaks and what contaminants are being <br />discharged as a result? <br />5. What assistance or services can you provide to the Shalom Ranch and <br />Mr. and NSrs. Cooper, so that they are assured that neither their ]ivestoclc nor their <br />crops are being contaminated as a result of the leaks? Would BMRI be willing to <br />monitor the water sources on the Shalom Ranch, without cost to Shalom Rand;, i <br />order to detenmine if any of the contaminants have reached their property-? <br />It is my understanding that the initial draft of the response plan, TR-15, is <br />now undergoing technical revisions. Please provide me a copy of TR-15 along «zth <br />the revisions, so that I can share those v`Rth Mr. and Mrs. Cooper. Mr. and Mrs. <br />Cooper are particularly concerned, of course, that the seep from the West Pit or ot;~er <br />locations may pollute the ground water and the Rito Seco Creek. Please particularly <br />address these concerns in your responsive letter. I also request on behalf of my clients <br />that you send copies of am documents that you intend to send to representatives c~ <br />the Costilla County Conservancy District, the Western Mining Action Project, <br />
