Mr. and Mrs. Cooper graze cattle on their land which his adjacent to <br />the BMRT land and which is located immediately downstream from the "Nest Pit" of <br />the San Luis Mine Project. My clients also irzigate approximately 460 acres on their <br />property, which irrigated land is cun-ently involved in alfalfa production. As v_ ou can <br />imagine, Mr. and Mrs. Cooper are extremely concerned about this matter. <br />It is my understanding BMRT has developed a response plan, "TR-IS", whit}; <br />was drafted in response, at least in part, to the leak from the "West Pit". ]have also <br />been infornted that a hearing was held before the Colorado Mined Land Reclamation <br />Board on January 27, 1999, concerning that leak from the "West Pit". I Inave <br />received copies of letters from the Colorado Department of Public Health and <br />Environment (dated January 5, 1999, by Phil Hegeman and Don Holmer), the <br />Costilla County Conservancy District (dated December 14, 1998, and dated January <br />22, 1999, by Michael McGowan, Research Director), and the Western Mining <br />Action Project (dated December 10, 1998, by Roger Flynn, Attomev at Lew). The <br />information relayed in those letters was alarming in two major respects. First, it <br />would appear from that material that a very serious water quality problem may be <br />developing at the site as a result of the leak Second, it was not clear from those <br />letters that BMRI was either taking full responsibility concerning the potential serious: <br />nature of this leak or actively pursuing a complete remedy to the resulting problems. <br />
