The DOW additionally recommended including a forb species in the seed mix for wildlife value, which I support.
Please state whether you will commit to including a species for wildlife value, through obtaining a specific
recommendation from DOW, at such time that you are ready to begin revegetating slope areas. (This
recommendation could be something such as red clover, at a broadcast rate of 1.0 Ib PLS/ac., for example.)
Exhibit G -Water Information
You refer to the 1981 permit materials, which includes the statement that you will use groundwater th the pit for
dust suppression. 1 assume this is limited to water from the well in the pit. Please be reminded that you should
provide evidence of the right to use such water prior to such use. Also, if you expect to continue to expose
groundwater, or enlarge the amount of groundwater surface exposed in the pit, you will have to provide evidence of
an approved gravel pit well permit. You state that this has been applied for. Before the pit is mined to its full depth
in the expanded area, such evidence will have to be provided. (This covers a question under Exhibit M also.)
Exhibit R -Proof of Filing with the County Clerk
Regarding all additional filings for follow-up materials, which are required to be filed and receipts provided for
each (as you have continually provided me), I cannot find the one which documents the addition of the full exhibit
content for Exhibits L, N, O, Q, R, and S. Mr. Ftaley included that th his objection letter, and it should be
specifically answered. Please provide a copy of the receipt.
Exhibit S -Permanent Man-made Structures
The engineering report provided in the initial packet (4/99) included a safe setback distance of unmined material, in
order to protect McNally's house and KE Road. The Mining and Reclamation Plan maps do not show such a
setback to be maintained. Please state whether you will leave the recommended 150-foot setback from either of
these structures, and how the horizontal distance will be determined (e.g., from the fenceline or from the structure,
etc.).
At this time your complete responses will satisfy the requirements of the application. Please provide such as soon
as you can. Today is the Division's date for making a recommendation on the application. My phone is 970/247-
5193 and my fax is 970/247-5104.
Sincerely,
Bob Oswald
Environmental Protection Specialist
a:~nichols adeg2/rco
