Box 285 Michael B Long <br />Mesa CO 81643 Division Direclnr <br />Re: Nichols Gravel Pit, Permit No. M-81-013, Conversion Application CN-02, Second Adequacy Review <br />Letter. <br />Dear Mr. Nichols, <br />I have finished a complete review of all application items, plus my initial questions and your responses to-date, <br />concerning the above-named application. Overall the file appears to be nearly complete. There are a few items still <br />outstanding, which appear to be small clarifications for items we had discussed earlier, but which did not clearly get <br />documented for the file. My questions below are in the order of the exhibit to which they pertain. <br />Exhibit C -Pre-mining and Mining Plan Maps <br />I had asked about ownership of certain significant structures which were depicted on the maps, particularly the <br />fences and roads. Your response was that fences and dirt roads were the property of various Nichols family <br />members. Please additionally state who is the owner of the fence along the northern right-of--way of KE Road <br />which adjoins much of the proposed expanded permit boundary. Also, please state who is the otamer of the fence <br />which separates your land from Nina McNally. <br />The question about the access road alignment, and whether it had to be within an easement or if it could continue to <br />exist at its present location also falls under this exhibit. You provided an agreement between yourself and the gas <br />pipeline company, stating that you may continue to use the present road which is also the gas line location. This <br />will be the best solution, as long as you abide by their conditions, mdrer than move the road closer to McNally's <br />property and into the defined easement. Please be reminded that if new roads are constructed for purposes of <br />conducting this operation, they must be included within the permit boundary, and any new areas to add to the <br />permit require an amendment (which is neither quick nor inexpensive) simply for adding a road. <br />Exhibit E -Reclamation Plan <br />You have stated that your proposed revegetation plan will include several species of grass seed and tree seedlings <br />as recommended by the former Soil Conservation Service, but no specific seeding or planting rate was reiterated. I <br />will approve this mix of species based on those old recommendations, and will base my reclamation costs on those <br />rates. Interpretation of the old SCS recommendations, for your seed mix, indicates [he following broadcast seeding <br />rates: Indian ricegrass 3 Ibs PLS/ac; Sand dropseed 0.1 Ibs PLS/ac; and Western wheatgrass 8 Ibs PLS/ac. Please <br />state if you agree with this. <br />You also stated that you would plant pinyon pine and rocky mountain juniper seedlings, according to the SCs <br />recommended rates. Planting rates for trees are most easily determined, based on the old SCS reconunendations, <br />by estimating the amount of disturbed slope area and planting a tree for every 150 square feet. This accounting <br />combines the 10-foot and 1~-foot spacing included in the SCS report. Please state if you agree with this. <br />
