If the exclusive source of their ore was offsite for
any period of time was offsite ors is not the Division by its own
rules without jurisdiction to permit them.
Find attached a draft MOU with CDH concerning custom
milling. According to paragraph 2, a mill which accepts any
offsite sources of material would require a CDH Mill permit
including a Certificate of Designation. if this revision is
granted after the MoU is signed it would violate that agreement.
Even if the MoU is not signed, granting the revision would
violate CDH's interpretation of its own statutory authority.
The revision should be denied because the operator should be
required to get a custom milling permit.
7;. A close reading of the revision application is that it does
not request permission to mill offsite ore only ors that is
suitable according to the permit guidelines. No offsite ore is
ever mentioned. Therefore, no revision has actually been
requested since they already have such permission.
sincerely,
Evan Freirich
ec: Kim Gent
Nina Wiliiame
Hob Mason
Pri~t~d of fl~eyCtad P~o~r
