drawing with road designation, location and property ownership, will satisfy the <br />requirements of 4.03.1(1-(f)(ii- for haul roads and 4.03.2(111g1(ii) for access roads. <br />Stipulation 32 remains active. <br />Stipulation 33 <br />The permittee will submit, within a complete revision application, a relevant showing <br />statement in lieu of certification for the Coal Carrier's Access Road for insertion in the <br />permit application, to fulfill the"requirements of Rule 4.03.2/1/(f/(ii/, by November 28, <br />2003. <br />The operator did submit a complete revision application containing a relevant showing <br />statement. As such, Stipulation 33 is resolved. However, the relevant showing statement <br />as submitted is not fully adequate, and we have the following request. <br />2. The relevant showing statement in lieu of certification of the design and <br />construction of the Coal Carrier Access Road addresses only the requirements of <br />Rule 4.03.2(1)(a) through (d). Please amend the statement in lieu of certification to <br />address compliance with requirements of Rules 4.03.2(2), 4.03.2(3) (to the extent <br />that compliance can be observed and evaluated), 4.03.2(4-, 4.03.2151, and <br />4.03.2161. <br />PERMANENT OIL WELL ACCESS ROAD DESIGN MODIFICATION <br />3. The revision application contains amended Exhibit 13-25.2, which depicts a minor <br />alignment change for the postmine oil well access road. Based on ponding observed <br />at the location where the oil well road will join the MEHR haul road, it appears that a <br />culvert may be warranted in the immediate vicinity of this junction. Further, no <br />culvert or other type of drainage crossing is indicated for the road crossing of <br />Postmine Channel 006-NE1. <br />Please provide amended design to address installation of culverts or other <br />appropriate drainage structures to eliminate ponding at the junction of the oil well <br />road and MEHR, and to ensure that flow in Channel 006-NE1 is not blocked or <br />disrupted. <br />4. In reviewing the amended oil well road designs, we noticed that approved culverts <br />along the ridgeline access road (PM-1, 2, 3, and 4) were not depicted.on amended <br />Exhibit 20-2. Please revise Exhibit 20-2 to depict approved culvert locations along <br />the ridgeline access road. <br />005 GULCH TEMPORARY DIVERSION <br />In the cover letter to the application, the operator includes a response to the <br />Division's recommendation regarding temporary diversion of runoff from the recently <br />reclaimed "D" Pit area. The Division had suggested that the operator consider <br />construction of a temporary diversion to protect undisturbed segments of the 005 <br />Gulch drainage from accelerated erosion, until the reclaimed watershed is stabilized. <br />3 <br />
