Long <br />VVV"~~~ Division Director <br />RE: Whitewater Pit 500, Permit No. M-77-129, Amendment No. 2 Preliminary Adequacy Review <br />Dear Mr. O'Brian: <br />The Division has conducted the preliminary adequacy review of the Amendment No. 2 (AM-02) <br />application to Permit No. M-77-129. Following are the comments that must be adequately <br />addressed before the application can be approved. Please respond as soon as possible, or at least <br />by September 6, 1999, so the Division has adequate time to review your responses prior to the <br />September 15, 1999 decision due date. If you cannot submit your response by September 6, <br />1999, please submit a written request for an extension of the decision due date. If your <br />responses, or an extension request, are not submitted by September 6, 1999, this application <br />may be denied. <br />ADEQUACY COMMENTS <br />1. The application proposes to add to and remove areas from the current permit area. The areas <br />to be removed from the permit area must be removed per the release requirements of Rule <br />4.16. This release must be approved prior to approval of this amendment application. Due to <br />the timeframes involved in the release process, the decision due date for this application may <br />need to be extended to allow for a release request to be approved first. <br />Exhibit A - Leoal Description <br />2. The legal description indicates that a portion of the permit area lies in the SE/4SW/4 of <br />Section 28. The permit maps do not show any portion of the permit area in this <br />quarter/quarter section. Please clarify. <br />Exhibit C -Current Conditions Maa <br />3. Please identify the owner of the property between Smith and Proctor on the Exhibit Cn - <br />Adjoining Owners Map. <br />4. In Exhibit O, the list of adjacent landowners far the north site includes the names Ostrager and <br />Power. These names are not shown on the adjacent landowners map. Please clarify this <br />discrepancy. <br />
