January 24, 1980

Mr. Robert G. Biglow
P.O. Box 1037
Salida, Colorado fl1201
' RE: Ll, S. Soil Conditioning/J. F1. Lionelle
Our File No. 79-206
Dear 14r. Biglow:
III IIIIIIIIIIIIIIII
This letter has two purposes. First, I wish to respond to the supplementary
adequacy materials submitted to this office on January 8th concerning the
mining and reclamation permit for the above captioned operation. Second, I
wish to clarify the actions taken by the Mined Land Reclamation Board in
relation to this operation and discuss our conclusions concerning the bonatng
of the operation. I might and that the Colorado Divisi:n of (dater Resources
has no ob4ections to the mining operation itself. Rowever, I am submitting a
copy of your supplementary materials to them today in anticipation of their
comments (especially, I would assume, on Exhibit G-1).
My comments on the supplementary materials follow on an exhibit-by-exhibit
basis.
Exhibit C:
1. As we discussed yesterday, I am assuming that you will add the approximately
2 acres encompassing the 800-foot abortive haul road to the south~gf the
present mining affected acreage as new affected acreage. This will add to
the fee to be pGid slightly, and I will thus expect a check from you in the
proper amount. The mining plan and reclamation plan maps should also be
altered accordingly. If necessary, this change should be reflected ~.ti~ any
Future publication.
Exhibits A-1 and C-1:
r
1. Referencing map C-1, there appears to be acreage that is not included ,in
the legal description given ;n ~chibit A-1. These areas are a&as follow®'~
a.) Acreage to ~hBLMaacreageto4the westiof Lod 4windSections181 SThese
Company; and ~7
two tracts are affected land not described to the nearest quarter quart:e.r
section, and noQp;oof of legal right to enter has been provided for them,
The description P proof is needed for these two exhibits to be adequate.
This change should also be reflected in future publications.
