WATER WELL/RESERVOIR RELEASE M&M R, Ltd. hereinafter called operator, and The Bureau of Land Management, hereinafter called BLM, do enter into an agreement by and between these parties, for release of liability, responsibility and rights associated with the following projects no longer needed by the operator. The remaining water well and the reservoir aze located at T. 9 N., R. 92 W., Sec. 9, SE, NW in Moffat County Colorado. Said water well and reservoir were constructed expressly for the operations of the Joker Mine site. The Bureau of Land Management (BLM) acting through the Secretary of the Department _ __ _of the Interior, agrees to assume control and responsibility of the water well and_ _ __ reservoir, with the condition that the remainder of the project will be reclaimed to the partial abandonment project standards. The described projects (well and reservoir) will nat need to be reclaimed by the operator. This agreement releases the operator from any obligation or liability for plugging the well or reclaiming the reservoir area of disturbance. The operator agrees to quitclaim all rights to said water well and reservoir to the BLM in lieu of plugging the water well to surface and reclaiming the reservoir site. It is further agreed by the undersigned, that the owners of record title to the above leased mining claim having produced the well and reservoir aze relieved from surety bonds and liability in connection with the said water well and reservoir, once the remaining reclamation is completed to abandonment standazds.
