<br />Section I -History <br />Peabody Coal Company submitted an application to renew the valid, existing permit for surface coal <br />mining operations at the Seneca II-W Mine on June 18, 1990. The application was deemed <br />complete on June 28, 1990. The application was approved with conditions and the five year permit <br />term was renewed on January 1, 1991. <br />Peabody Coal Company submitted an application for a permit revision to the Seneca II-W Mine plan <br />on November 13, 1990. The revision included plans to open the north mining block, construct <br />Sediment Ponds 005 and 009, and Roads G and H. The application was deemed complete on <br />November 23, 1990. The Division's adequacy concerns were related to the operator on Manch 11, <br />1991. Peabody Coal Company responded on Apri129, 1991. Additional adequacy concerns were <br />sent to the operator on May 23 and June 3, 1991. Peabody responded to those concerns on July <br />1 and July 22, 1991. The application was approved with conditions on September 4, 1991. Pond <br />009 was constructed in the fall of 1991. Pond 005 and Road G were constnucted in the summer <br />of 1992, and the north mining block opened that fall. <br />On June 18, 1993, the Division received notification that Peabody Coal Company -Western <br />Division, operator of the Seneca II-W Mine, was operating under the trade name Peabody Western <br />Coal Company (PVJCC). <br />Seneca II-W Mine Page 2 <br />
