<br />-2- <br />The additional area encompassed by the Sanborn Creek addition to the Somerset <br />Mine permit area is located in portions of the following described lands: <br />Township 13 South, Range 90 West, 6th PM <br />Sec. 3: SW/4, SE/4 <br />Sec. 4: SE/4 <br />Sec. 9: North of Highway 133 <br />Sec. 10: North of Railroad <br />The Sanborn Creek Mine permit area contains 962 acres of land of which 793 <br />acres are on private land owned by the Operator and 169 acres are on Federal <br />land. <br />The combined permit area of the Somerset Coal Mine and the new Sanborn Creek <br />mine contains 3,737 acres of land of which 1,608 acres are on private land <br />owned by the Operator and 2,129 acres are on Federal land. <br />The mine permit areas are located on the U,S. Geological Survey 7,5 minute <br />Bowie and the U.S. Geological Survey 7.5 minute Somerset Quadrangle. <br />The Somerset Coal Mine is located due north of the town of Somerset, Colorado, <br />which is nine miles northeast of Paonia, Colorado on Highway 133. The North <br />Fork of the Gunnison River is located due south of the town of Somerset. The <br />Sanborn Creek addition to the Somerset Mine is to be located approximately one <br />mile east of the town of Somerset at a location that is north of Highway 133 <br />and north of the railroad tracks. <br />This proposed approval decision is based on a finding that the proposed <br />operation will comply with all requirements of the Colorado Surface Coal <br />Mining Reclamation Act, C.R.S. 34-33-101, et seq., and the regulations <br />promulgated thereunder. <br />Copies of the proposed decision including stipulations, are on file for public <br />inspection at the Colorado Mined Land Reclamation Division, Room 215, <br />Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at the <br />County Clerk's Office in Delta County, 5th & Palmer, Delta, CO. Persons with <br />an interest that may be adversely affected by the proposed decision may <br />request a formal hearing before the Mined Land Reclamation Board on the <br />proposed decision. Such request must be made within thirty (301 days of the <br />initial publication of this notice, must be in writing, and must state with <br />reasonable specificity the reasons for the request and the objections to the <br />proposed decision. <br />1524G <br />
