5) Please note that the citation of the definition of Inert
Materials in the Colorado Mineral Rules and Regulations on page E-2
is now incorrect. With the adoption of the new Construction
Materials Rules and Regulations this January, this citation is now
section 1.1 (20), not 1.1 (24). This is the definition that must be
complied with under your permit.
6) Two objectors have come forward to lodge formal objections to
the .Amendment as it stands now: the City of Aurora, which is
objecting to the project based on possible negative water quality
impacts, and the Urban Drainage and Flood Control District, which
is objecting based on possible erosion problems which may develop
in the drainage (if flood control structures are not installed).
DMG agrees with the evaluation done by the Urban Drainage and Flood
Contx•ol District, and believes that a flood control structure to
reduce erosion and headcutting in the drainage should be installed.
An Informal Conference will be scheduled as soon as possible so
that all parties may meet and discuss the issues, and hopefully
resolve any conflict.
The decision due date for your application is February 27, 1996.
Plea;:e submit the requested information to DMG prior to this date.
If this application remains as is, DMG will be required to deny the
permit at this time. However, if the necessary changes are made,
then DMG's outstanding technical adequacy issues will be resolved.
If you have any further questions, please contact me at 866-3567.
Sinceerely,

Chri::tina L.
