Tuttle,
This letter is being written to address technical adequacy issues
in your company's amendment application to permit #M-88-044. The
following issues must be resolved before the Division of Minerals
and G,aology (DMG) can evaluate the amendment application.
1) In Exhibit G (Water Information) it is stated that a channel
diver:aion will be constructed in the Lowlands section of the
amendment area, should it become necessary to divert water away
from the mining in the creek bottom. DMG needs the following
information in order to make a determination with regard to the
amendment application:
<i) the basic dimensions of the channel to be constructed,
including sloping and any erosion control measures
li) the approximate location of the channel in relation to
the mining and the original creek bed
c:) the reclamation measures to be taken to return the
diver:;ion to its original state, including a cost estimate of the
tasks involved in such reclamation.
2) In Exhibit D (Mining Plan) there is some discussion regarding
the monitoring of the groundwater table, and the measures to be
taken if the groundwater level falls two feet below the average
depth.. Specifically, it is stated that:
"If the ground water Qeclines more than two feet below its
normal fluctuation of 1 to 1 1/2 feet in the Cottonwood groves,
then t:he trees will be monitored for signs of stress such as limb
die-oi.'f, leaf size reduction, changes in weight of tree litter, or
tree mortality. If significant stress is noted, the operator will
decrease the depth of mining or increase the setback from tree
grouper . "
