The Division had <br />received comments from other agencies regarding the <br />amendment application. Per our discussion over the phone, <br />regarding Arapahoe county's comments, it is the <br />understanding of the Division that you have agreed in <br />principal to be in compliance with their concerns during <br />their Use by Special Review Permit process, that you <br />intend to obtain from the county. <br />The Division is also in total agreement with the lists of <br />requirements for the operator as listed in pages 2 thru 6 <br />of your amendment application, that clearly details what <br />is allowed and not allowed by the operator with in the <br />permit and proposed permit areas. <br />II)Exhibits "A", "B" AND "C" ADEQUATE. <br />III)Exhibit "D" MINING PLAN <br />1)It is the understanding of the Division that you have <br />agreed to be in compliance with the Army Corps request <br />for a set back in the Ephemeral drainages. However, in <br />your statement on page 16 "Coal Creek Channel Setback", <br />you stated that No minino or deposition of overburden <br />or other disturbances that can cause significant damage <br />to the surface or other existing vegetation can occur <br />within 100 feet of the nearest edge of the channel of <br />Coal Creek".
