engineering studies to assess slope stability. With the exception <br />of the first year after construction, this area has been stable. <br />Further, the surface owners at the Grassy Gap Mine requested <br />Rockcastle to leave the access road open after final reclamation. <br />Rockcastle believes that completion of the proposed buttress would <br />make this road unusable. Rockcastle feels this demonstrated <br />stability is indicative of the long-term stability of this part of <br />the mine site. <br />NOV C-89-034 was issued to Rockcastle for failure to meet <br />hydrologic balance performance standards. Rockcastle proposes <br />completing appropriate onsite reclamation to ensure proper site <br />drainage and to assure that further sediment ponds inlet channel <br />downcutting will not continue to abate NOV C-89-034. Onsite <br />reclamation would replace the submission of engineering studies <br />currently specified for abatement of NOV C-89-034. <br />NOV C-90-007 was issued to Rockcastle for failure to submit <br />a total reclamation bond of $572,000. Rockcastle proposes to <br />conduct the previously described reclamation activities to reduce <br />bond liability at the site to abate this NOV in lieu of submission <br />of a bond supplement of $125,320. Completion of this reclamation <br />plan will substantially reduce bond liability at the site and, <br />therefore, bring the cost of remaining reclamation activities into <br />agreement with the retained reclamation bond amount discussed in <br />Section 4 below. <br />Stipulations 5 of the Board Order required submission of an <br />approximate original contour assessment and stability analysis for <br />Pits 5 and 6. Rockcastle is currently required to comply with <br />Stipulation 5 by June 15, 1990. Rockcastle proposes to complete <br />the required studies upon completion of all backfilling and grading <br />activities. Many of the activities required to comply with <br />-2- <br />
