1. INTRODUCTION. <br />This comprehensive proposal is submitted by The Rockcastle <br />Company ("Rockcastle") to the Colorado Mined Land Reclamation <br />Division ("CMLRD") to resolve all issues relating to Rockcastle's <br />liability for reclamation and environmental protection at the <br />Grassy Gap Mine. The proposal contemplates completion of <br />reclamation at the Grassy Gap Mine site during 1990. The proposal <br />also resolves all outstanding reclamation issues regarding the <br />Grassy Gap Mine including: (1) compliance with Stipulations 5, 6 <br />and 7 contained in the Colorado Mined Land Reclamation Board Order <br />issued December 14, 1989 (the "Board Order"); (2) resolution of <br />Notice of Violation ("NOV") Nos. C-89-034 and C-90-007; and, (3) <br />permit renewal issues. Finally, the proposal contemplates a full <br />and final resolution to Rockcastle's liability for the site under <br />the Colorado Surface Coal Mining Reclamation Act. §34-33-101, et <br />seq., C.R.S. <br />2. PROPOSED RECLAMATION ACTIVITIES. <br />Rockcastle proposes to complete backfilling and grading, <br />topsoiling and reseeding of Pit 4 during the 1990 construction <br />season in general accord with the permit reclamation plan. <br />Rockcastle will consider additional backfilling and grading <br />in areas of Pits 5 and 6 which are potentially not in accord with <br />the proposed post-mining topography only where these areas are <br />demonstrably geotechnically unstable. Rockcastle has retained ACZ, <br />Inc. to perform necessary stability studies to assure that Pits 5 <br />and 6 achieve long-term stability goals. <br />Emplacement of a buttress along the site access road will be <br />considered by Rockcastle only if the slope has demonstrable long- <br />term stability problems.
