Krueger <br />The Division has received Kiowa County's above referenced response in regard to Compliance Problems I and 2 <br />identified in the Division's report of the inspection of the pit on July 17, 2000. Lonn <br />o~~h.,,n o~r~•~I„r <br />Compliance Problem 2): Conflict between approved mining plan and reclamation plan in regard to <br />salvaging sufficient topsoil at the site to Complete the reclamation plan. <br />This problem is considered abated if the commitment to import enough topsoil to satisfy the requirements <br />of the reclamation plan is included in the permit as a Technical Revision. Since the County's commitment <br />addresses the most important result of the existing conflict between the requirements of the mining and reclamation <br />plans, i.e. a deficiency in salvaged and stockpiled topsoil, and clarifies the County's intention to provide enough <br />topsoil to complete the reclamation plan, the Division will consider the commitment as n Technical Revision to the <br />permit and accept it without the County being charged an application fee However, if the County does not agree <br />[hat the commitment is to be considered a Technical Revi;ion to the permit, the Division should be notified of this <br />in writing prior to the revision decision dale of November 1, 2000. <br />If you have any questions on the above, please contact me. <br />Sincerely. <br />~Q,NNQ7 G S~le~-I,N <br />James C.
