Lonp <br />Div Trion DIrrUO! <br />Terrell had two comments he wanted to make to our Midterm Review <br />issued November 23, 1992: <br />1. Page 2, last sentence: Terrell correctly pointed out <br />that the mine was not "idled" during strike, as written, <br />but was operating with a reduced work force and decreased <br />production (see attached photo copy of page 2). <br />We agreed that a statement to this effect would be <br />included in this memo to be included in the Midterm <br />Review file. <br />2. Pages 8 & 9: Terrell believes this paragraph is <br />incorrect because he believes that the Eagle Mine has the <br />right to damage the Williams Fork River alluvial valley <br />floor while doing full extraction but must prove to us <br />that they can repair the hydrologic balance. As evidence <br />of this he asked the Division to consider page 16 of the <br />findings document issued by the Division on April 24, <br />1987 for the Eagle Mines (see attached pages). <br />I said that I would refer this to Jim Pendleton as it was <br />his suggestion that this statement by the Division be <br />included in the Midterm review. <br />cc: Terrell Johnson, Cyprus Empire <br />Jim Pendleton, DMG <br />Larry Routten, DMG <br />
