Phil Jensen <br />• 9 Oct 97 <br />Page IS of 18 Pages <br /> <br />bond the Division shall, within thirty (30) days or as soon thereafter as <br />the Division determines weather conditions permit, conduct an <br />inspection and evaluation of the reclamation work involved. Such <br />evaluation shall consider, among other things, the results of <br />inspections and monitoring conducted pursuant to 4.05.13 and 5.02, <br />the degree of difficulty to complete any remaining reclamation, and <br />whether pollution of surface or subsurface water is occurring, the <br />probability of future occurrence of such pollution, and the estimated <br />cost of abating such pollution. The written results of such inspection <br />and evaluation shall be made immediately available for public <br />inspection in the offices of the Division. "As soon thereafter as <br />weather conditions permit" means that the Division must be able to <br />evaluate properly the reclamation operations alleged to have been <br />completed and, therefore, may be subject to seasonal limitations. The <br />surface owner and agent or lessee, if any, shall be given reasonable <br />notice of such inspection, and may participate with the Division in <br />making the inspection. The Division may arrange with the permittee <br />to allow access to the permit area, upon request by any person with an <br />interest in bond release, for the purpose of gathering information <br />relevant to the proceeding. <br />125(3) (3) Objections to Requested Release. <br />Any person with a valid legal interest which might be adversely <br />affected by release of the bond, or any Federal, State, or local <br />government agency which has jurisdiction by law or special expertise <br />with respect to any environmental, social, or economic impact <br />involved in the operation, or is authorized to develop and enforce <br />environmental standards with respect to such operations, shall have the <br />right to file written objections to or comments upon the requested <br />release from bond and file a request for an informal conference with <br />the Division within thirty (30) days of the last publication of the notice <br />required in (1)(b) above, or within thirty (30) days of the completed <br />inspection, whichever is later. Upon receipt of any such objection or <br />comments, copies thereof shall be vansmitted to the permittee. <br />125(8) (4) Informal Conference on Objections to Requested Release. <br />Without prejudice to the rights of any person who might be adversely <br />affected, the permittee, or the responsibilities of the Division pursuant <br />Enclosure 4 <br />
