City of Golden <br />83CW361 <br />• injury to other water users in view of the fact that Golden <br />presented evidence that its actual irrigation return flows may <br />exceed 30x. <br />11. Plan for Exchange. By this application Golden seeks the <br />right to store by exchange the Vidler Tunnel Water in the Golden <br />Reservoirs. The Court finds tnat no vested water right or <br />decreed conditional water right will be injured by the requested <br />exchange. <br />12. Reservoir Operations. The Golden Reservoirs are located <br />in the saturated sands and gravel adjacent to West Clear Creek in <br />an old buried channel of West Clear Creek. These reservoirs <br />shall be administered as on-stream reservoirs using level <br />controllers, stage measurements and other measuring devices as <br />may reasonably be required and approved by the State Engineer. <br />The water levels in the reservoirs shall be regulated to account <br />properly for evaporation, storage, seepage and releases. Water <br />may be diverted into and/or through the reservoirs out-of- <br />priority in order to maintain the proper storage quantity, <br />provided that depletions caused by evaporation and changes in <br />storage are replaced by the release of water from the <br />reservoirs. In the administration of its augmentation plan in <br />relation to the Golden Reservoirs, Golden shall not be deemed to <br />have lost dominion and control over any seepage but of its <br />Henderson Mine, Berthoud Pass Ditch, or Vidler Tunnel water which <br />may have been previously stored in the Golden Reservoirs. <br />Consequently, Golden shall be entitled to store water out-of- <br />priority in order to recapture such transmountain and <br />nontributary water which has seeped out of the reservoir. By <br />using this method of reservoir administration, other water users <br />will not be injured. Nothing herein shall be deemed to allow <br />Golden to recapture the seepage out of the reservoirs of <br />tributary waters native to the South Platte River Basin. During <br />the period of retained jurisdiction, a representative of Golden <br />shall personally read the level measurements and verify the <br />accuracy of the level controllers on a weekly basis. After the <br />end of the period of retained jurisdiction, such verification <br />shall be performed once per month.
