presented evidence that its actual irrigation return flows may
exceed 30x.
11. Plan for Exchange. By this application Golden seeks the
right to store by exchange the Vidler Tunnel Water in the Golden
Reservoirs. The Court finds tnat no vested water right or
decreed conditional water right will be injured by the requested
exchange.
12. Reservoir Operations. The Golden Reservoirs are located
in the saturated sands and gravel adjacent to West Clear Creek in
an old buried channel of West Clear Creek. These reservoirs
shall be administered as on-stream reservoirs using level
controllers, stage measurements and other measuring devices as
may reasonably be required and approved by the State Engineer.
The water levels in the reservoirs shall be regulated to account
properly for evaporation, storage, seepage and releases. Water
may be diverted into and/or through the reservoirs out-of-
priority in order to maintain the proper storage quantity,
provided that depletions caused by evaporation and changes in
storage are replaced by the release of water from the
reservoirs. In the administration of its augmentation plan in
relation to the Golden Reservoirs, Golden shall not be deemed to
have lost dominion and control over any seepage but of its
Henderson Mine, Berthoud Pass Ditch, or Vidler Tunnel water which
may have been previously stored in the Golden Reservoirs.
Consequently, Golden shall be entitled to store water out-of-
priority in order to recapture such transmountain and
nontributary water which has seeped out of the reservoir. By
using this method of reservoir administration, other water users
will not be injured. Nothing herein shall be deemed to allow
Golden to recapture the seepage out of the reservoirs of
tributary waters native to the South Platte River Basin. During
the period of retained jurisdiction, a representative of Golden
shall personally read the level measurements and verify the
accuracy of the level controllers on a weekly basis. After the
end of the period of retained jurisdiction, such verification
shall be performed once per month. Evaporation shall be
calculated as follows:
