City of Golden <br />d3cw361 <br />• (2) 85~ of such irrigation use will be consumed, <br />with the remainder (15~) returning to the Clear Creek/south <br />Platte River system as return flows. Therefore, lawn irrigation <br />return flows attributable to out-of-priority diversions shall be <br />determined as 15S times the amount of irrigation water use (as <br />calculated pursuant to paragraph 10.a.(1) above) times the <br />monthly factors set forth in paragraph t0.a.(3) below times the <br />ratio of out-of-priority diversions to total diversions. Golden <br />shall not under this decree claim credit for irrigation return <br />flows resulting from the use of nontributary or foreign water but <br />Golden shall have the right to file an application seeking credit <br />for return flows resulting from the use of such water in the <br />future. <br />(3) To account for the delay of return flows, the <br />monthly distribution of the irrigation return flows shall be <br />determined using the following monthly percentages: <br />January 1.7 July 21,1 <br />February 1.1 August 20,3 <br />March 0.7 September 16.7 <br />April 1.9 October 11.4 <br />May 4.1 November 5.2 <br />June 12.8 December 3.0. <br />• (4) 72R of these return flows shall be credited to <br />Golden at a point on Clear Creek just upstream from the Croke <br />Canal and 28~ of these return flows shall be credited to Golden <br />at a point on Clear Creek just downstream from the Oulette Ditch <br />via Lena Gulch. Golden shall only receive credit for the return <br />flows which enter Clear Creek via Lena Gulch downstream from the <br />Slough Ditch during such periods as Lena Gulch is a live stream <br />(as defined in paragraph 6.a.(2)} from the Golden city limits to <br />the confluence of Clear Creek and Lena Gulch and as long as Clear <br />Creek is a live stream from the point of diversion of the Golden <br />Water Works First Enlargement to the point of confluence of Clear <br />Creek and Lena Gulch. In addition, Golden shall receive credit <br />for return flows through Kennys Run only at such time as the <br />bypass of Kennys Run around the Welch Ditch is in operation. <br />b. Every five years, Golden shall submit to the State <br />Engineer a report calculating the amount and location of lawn <br />irrigation return flows. The procedures and techniques used in <br />preparing such report shall be those set forth in Exhibit E <br />hereto. So long as the report demonstrates that return flows are <br />at least 15~, Golden shall be entitled to credit for 15%. If <br />return flows are calculated to be less than 15~, Golden shall be <br />entitled to credit only for such lesser amount. <br />c. The foregoing method of calculating depletions from <br />lawn irrigation is reasonable, administrable and will prevent <br />12_ <br />
