Water stored in priority or by <br />exchange in the Golden Reservoirs, more particularly described in <br />paragraph 4.b. above. <br />6. Change of Water Rights. By this application Golden <br />seeks the following changes with respect to its Agricultural <br />Water Rights: <br />a. Subject to approval of the alternate point of <br />discharge for the Coors/Golden wastewater treatment plan more <br />particularly set forth in paragraph 9.c. below, a change in use <br />to include domestic, municipal (including fire protection}, <br />commercial, irrigation, industrial, recreation, aesthetic, <br />manufacturing, and storage. The utilization of the Agricultural <br />Water Rights for the proposed new uses shall be subject to the <br />following conditions and limitations (collectively hereinafter <br />the "Historic Limitations"): <br />(1) the historic season of use and rates of flow <br />set forth in the attached Exhibit A; provided, however, that no <br />credit shall be taken for the Agricultural Water Rights during <br />such periods when they are out-of-priority; <br />(2) the existence of a live stream between the <br />original diversion points of the Agricultural Water Rights and <br />• the Church Ditch (for purposes of this ~iecree, the term "live <br />stream" is defined as any and all times during which the Water <br />Commissioner is ordering water past all headgates in the <br />described section of the stream}; <br />(3) diversions or augmentation credits shall be <br />limited to the amounts set forth in the attached Exhibit B; <br />provided, however, that no more than one-half of the total <br />maximum 20-year amount may be utilized during either the first <br />ten years or the second ten years of the first 20 year period; <br />{4) ditch losses shall be assessed as set forth in <br />the attached Exhibit C; <br />(5) the replacement of historic return flows, upon <br />the following terms: <br />(i) The replacement of such return flowing <br />during the historic season of use will be met by the historic <br />consumptive use limitations. The sole exception to this is the <br />Church Ditch. Return flows from this water right will be left in <br />the Church Ditch for delivery to the Ralston and Little Dry Creek <br />watersheds in accordance with the schedule set forth in the <br />attached Exhibit D-t. <br />• <br />-7- <br />
