stockpiles ~ci" .~'so be near the mined area, but as stated before, we anticipate they will be
hauled out as crushed. Since the pit area is small, it will necessitate hauling as material is
crushed. I have added the additional information requested in the reclamation map.
Exhibit I -Proof of Filing with the County Clerk
i know the county clerk indicated "recorded", but that was her mistake. I asked her to file it
and she erroneously marked "recording" before we realized it.
Exhibit L -Permanent Doan-made Structures
[n your inspection report dated 7/20/00 your mention several manmade features that need
to be addressed in the amendment. These include a buried water pipeline, imgation risers
and valves, a cattle guard, several fencelines in the amended area and an earthen contour
ditch in the amended area. All of the above are the property of Walter Bump and Cecil
Henry dba Pine River Cattle Co. who are also the owners of the property. Since this
amended permit will be succeeded to them on approval, they are not requiring a damage
compensation agreement for any of these features. There is also a power pole and power
line adjacent to the entrance to the pit that belongs to La Plata Electric Association. I have
enclosed a copy of a letter to Rand}' Fems at La Plata Electric Association requesting a
signature on an Indemnification and Damage Agreement regarding this pole.
Hopefully the existing exhibit is adequate because of pre~rious information given regarding
stormwater and sediment controls and hydrocarbon secondary contaitunent.
Other Items
I have submitted proof of publication on this amendment to the Division. I will file this
proof of publication, your letter to me and this letter in response with the county clerk's
office today. Receipts are included with this letter. I have enclosed a copy of notice to the
landowners within 200 feet of the site. This was sent certified mail and I will forward the
receipt to you as soon as I receive it.
We will have another sign posted by next week as well as the boundazies of the existing and
amended azea marked with fence posts. We have also marked the north side of the pit to
showing the setback distance between the rirrt and the edge of the disturbed area, to protect
the canyon from erosion, sedimentation, and the pit from impounding water.
I would like to request a further extension of one month in order to allow sufficient time for
a decision to be made on this matter.
Thank you for all your assistance in this amendment application. It is my hope that we can
complete this successfully as well as start the succession application to Fesco, Inc.
Sincerely,
Gilleland
Office Dlanager
