Susan J. Mowry <br />Page 2 <br />8. The Operator believes that the two monitoring wells, H- <br />__ 10 and B-6 provide adequate information on the water levels in <br />the mine. The information provided by the two wells is neither <br />easy or straight forward to analyze, but the two wells do provide <br />the data necessary to predict what is going on inside the mine. <br />The Operator currently samples the two wells quarterly and ana- <br />lyzes the water using a long list of parameters. A substantial <br />amount of good baseline data has been developed from these analy- <br />_ ses. The Operator proposes to continue to sample the wells for <br />depth to water and field parameters each quarter. The quality of <br />the water will be sampled once per year, during the fourth quar- <br />ter, using the long list of parameters. <br />9. Although the facilities mentioned in this section are <br />probably not going to be used for the mining operation again, the <br />Operator is not willing to commit to a specific time table for <br />reclamation of them. <br />10. The Operator has reviewed the request to consolidate <br />_ the sedimentation ponds at the Elk Creek yard and has decided not <br />_. to change the sedimentation control system at this time. The <br />Operator believes the ponds function as designed and perform in <br />accordance with applicable MLRD Rules. <br />_ _, 11. A small portion of the surface disturbance at the upper <br />Hubbard Creek ventilation facility is in the National Forest. <br />The Operator is setting up a meeting with a representative from <br />the local Forest Service Office in order to obtain a determina- <br />tion that no significant recreational, timber, economic or other <br />.-:values are incompatible with the surface disturbance. That <br />determination will be forwarded to the Division when it is re- <br />ceived. <br />12. Not addressed in this transmittal. <br />13. As maps are updated during this permit renewal process <br />_ and during an upcoming permit revision process, the permit area <br />boundary will be added to the maps where the map covers the <br />permit boundary. <br />14. Not addressed in this transmittal. <br />15. The information requested is contained in Appendix B-1. <br />A reference to this location is contained in the last paragraph <br />on page 2.05-25. <br />16. Water rights have been conveyed to the Operator from <br />Kaiser Coal Corporation along with the deed to the fee surface <br />and coal. The deed has been recorded in both Delta and Gunnison <br />counties. <br />I <br />
