Rule 4.02.3 Perimeter Markers. The perimeter of a permit area for surface coal mining <br />activities, or in the case of underground mining activities, the perimeter of all areas affected by <br />surface operations or facilities, shall be clearly marked before the beginning ofsurface coal <br />mining operations. <br />The perimeter of all areas affected by surface operations or facilities are clearly marked, but are <br />not of uniform design [see Rule 4.02.1(2)]. (see page 2.05-12, lines 12 and 13) <br />Rule 4.02.5 Stream Buffer Zone Markers. <br />Buffer zones established under the provisions of 4.05.18 are clearly mazked. <br />Rule 4.02.7 Topsoil Markers. <br />Topsoil stockpiles are clearly mazked. <br />Rule 4.03 ROADS <br />The permit is in compliance with this rule. Identification begins on page 2.05-67, but other road <br />descriptions are scattered throughout the PAP. Afrer completions, as-built drawings of the 18- <br />Right and 6 NW Vent Shaft roads need to be incorporated into the PAP [Rule 4.03.2(1)(f)(i)]. <br />Rule 4.04 SUPPORT FACILITIES <br />The permit is in compliance with this rule. Descriptions are scattered throughout the PAP. <br />Rule 4.05 HYDROLOGIC BALANCE <br />The permit is in compliance with this rule. Descriptions are scattered in the PAP. <br />Rule 4.05.9(1) The design, construction and maintenance of all impoundments, including <br />sedimentation ponds, or other treatment facilities shall be incompliance with 4.05.9. <br />Compliance with 4.05.9 shall not relieve the person from compliance with all applicable Federal <br />and State water quality standards. <br />No design was found in the permit for the evaporative lagoon at the Fish Creek Tipple or <br />the impoundment at the 18-Right Ventilation Shaft. See Rule 5.05.9(14) below. <br />Rule 4.05.9(14)(a) Such inspections shall be made regularly during construction, upon completion of <br />construction, and at least yearly until removal of the structure or release of the performance bond. <br />No certified as-built was found for the sewage evaporation pond at the Fish Creek Tipple or <br />the 18-Right Ventilation Shaft. <br />2005 Midterm Review, C-1982-056, November 17, 2005, Page 12 of 14 Pages <br />
