by longwall mining. In addition, the specific compliance dates and measures will be the <br />following.' <br />July 1, 2001 -Complete the drilling program, as referenced in the Colorado Division of <br />Water Resources letter to the Division, dated February 9, 2001, including installation of <br />pieZOmeters or other down-hole instrumentation. <br />2. September 1, 2001 -Submit the results of the investigation and seismic evaluation of the <br />structure, including recommendations for any additional instrumentation, will: the above- <br />referenced technical revision for Division review and approval. <br />3. November 1, 2001 -Install any additional instrumentation in accordance with the final <br />instrumentation plan approved in the above-referenced technical revision. <br />4. Gather all baseline data as required in the above-referenced technical revision, before <br />mining proceeds within a 1 mile radius of the dam. <br />5. Provide a final report and impact analysis, by a second technical revision, at least 90 <br />days prior to anticipated mining within one mile of the dam. <br />Mining within one mile of the Terror Creek Reservoir (Bruce Park dam) will not be approved <br />until all necessary monitoring data, analyses, reports and subsidence control plan details are <br />approved, by the second technical revision, and it is shown that such mining will not adversely <br />impact the dam. <br />Bowie Resources has submitted a geotechnical report and a seismic monitoring plan to satisfy <br />step number two of Stipulation No. 9. I am requesting [hat Byron review the submittal and see if <br />the geotechnical report is sound and if the seismic monitoring plan is adequate for its intended <br />purpose and consistent with our regulations. <br />Attached is a copy of the submittal cover letter and proposed revised pages and a copy of the <br />geotechnical report. The proposed seismic monitoring plan is on proposed pages 2.05-113 and <br />2.05-114. I have also attached two approved maps, Map No. 14, "Mine Plan", and Map No. 27, <br />"Subsidence." I will be in the field next week until Friday. <br />The Division's adequacy review letter is due October 26, 2001. I talked to Jim Norfleet today. <br />He will look at the submittal on Monday. He said he will supply his comments by October 19, <br />2001. If Byron and Kent could get their comments to me by October 26, I would greatly <br />appreciate it.
