I am requesting Byron's and Kent's assistance in the review of a geotechnical report and seismic
monitoring plan for Bowie No. 2. Byron's engineering expertise is needed. Also, Kent was in on
the original review of the plan.
When Bowie Resources proposed a mine plan in Permit Revision No. 4, the Division was
concerned that mining would come close enough to the Bruce Park Dam, also called the Terror
Creek Reservoir, to cause adverse effects to the dam's integrity. The Bruce Pazk Dam is a Class
One structure.
Upon consultation with Jim Norfleet of the Colorado Division of Water Resources out of
Montrose, it was decided that Bowie could not longwall mine within one mile of the dam until a
subsidence study was performed. To make sure the subsidence study was done in advance of
mining, the Division added Stipulation No. 9 to the approval for PR-04. The stipulation was
written with help from Jim Norfleet and Kent. The stipulation follows:
Stipulation No. 9
A detailed subsidence study for Terror Creek Reservoir dam (Bruce Park dam) will be completed
and approved prior to mining within one mile of the dam. The study will establish baseline
conditions, potential mining-induced seismicity and potential translated effects to the dam.
By September 1, 2001, Bowie Resources will submit a technical revision to the permit addressing
the investigation, data collection, analysis, and monitoring plan to ensure the safety and integrity
of the Terror Creek Reservoir dam (Bruce Park dam). The revision materials will include, but
not be limited to, data, a technical report, compliance schedules, a subsidence control plan, a
detailed monitoring plan specific to potential seismicity and any other potential impacts induced
