Shuey
Environmental Protection Specialist
Division of Miner.ils and Geology
1313 Sherman Street, Room 215
beaver, CO 80203
Re:
Reclamation Permit Partial Release Request Consideration
Dear Mr. Shuey:
I represent and am writing on behalf of the City of Rifle. The City Manager, City Engineer,
Public Works Dlreetor, Duector of Pl ann~ and I met on Apri14'" to review and discuss the notice
of the partital release request that you transmitted to the City Manager on March 21S°, We noted that
comments or objections should be made within 15 days or by today, Apri15`". Our consulting
engineer, Jeff Simonson, spoke with Russ Means of your office and we have received a copy of his
letter to United Companies dated March 28, 2002. We understand that a Technical Revision of the
Reclamation Plan will be required. Nonetheless, it is unclear whether the comment period is
expiring today. Therefore, we are writiuag to ask for an extension of that comment period until we
have received a copy of the Technical Revision to be filed by the Applicant.
Although the City is not yet under contras, the City is coatempLlting purrh~ a portion
of what l believe is Phase 1 which includes what we call the Bailey Pond, the most westerly pond
located oa the property. The Ciry is collating acquiring the property in conjunction with the
acquisition by another party fiom the current owner of the balance of the Phase T property to the
east of the pond, and then developing the pond as the City's water supply intake, However, as
noted, the City is not yet under contract for this purpose although it is in the process of preparing
such a contract.
In the Reclamation Repon dated March, 2002 that was Ztanem;rrP~ to us with your cover
letter, there are several starnmPntc with which the City is unaware of the source. Specifically, none
of the people who participated in am meeting "requested that the shore of the westernmost lake at
the site be kept free of vegetation." Moreover, we are unaware of the source of the statement
"according to the City officials, grounds maintenance becomes a simpler task if vegetation is kept
r.~zamaxn~u~zflaa ~~~.oya
