Catrany <br />Divuior DirEC[or <br />NaNal Resource Trustee <br />Based on the phone conversations I had with you and Marilyn on June 6 and 7, 2006 regazding your intention to <br />mine gravel from the Grand Gravel Pit at 3:1 (H:V) slopes, I have recalculated the required bond. The previous <br />bond that I calculated in the amount of $43,681.00 was based on mining with a high wall. The bond calculated <br />based on mining at 3:1 slopes amounts to $29,333.00. <br />The Division currently holds a bond in the amount of $19,406.00. However, based on the current site conditions <br />and the approved mining plan, the Division calculated that a bond in the amount of $29,333.00 would be necessary <br />to reclaim the current disturbance to apost-mining land use of rangeland. <br />According to Rule 4.2.1(1) and (2), the Division may review a financial warranty at any time to determine if the <br />amount is sufficient to perform reclamation. The result of the recalculation indicates that the site is currently <br />underbonded. This letter is to inform you that your financial warranty will need to be revised from its current <br />amount of $19,406.00 to $29,333.00 within 60 days of receipt of this letter. A copy of calculations used to <br />determine this cost is attached for your review. The operator has three options regazding the amount of required <br />bond; <br />1. submit additional financial warranty in the amount of $9,927,00, or <br />2. perform some reclamation on the site to reduce the reclamation liability <br />One of the two options must be completed by August 12, 2006. Failure to do so may be considered a violation of <br />the Construction Material Rules and Regulations.
