Long <br />1801 California Street ofvlslon Director <br />Denver, Colorado 80202-2636 <br />RE: Sanborn Creek Mine; File No. C-81-022; Transfer of Coal Mining <br />Permit <br />Dear Mr. Schwarz: <br />The Division received an application to transfer Mining and <br />Reclamation Permit No. C-81-022 from Pacific Basin Resources, A <br />Division of Oxbow Carbon and Minerals, Inc. to Oxbow Carbon and <br />Minerals Inc. Proof of publication, as required under Rule <br />2.08.6(3) of the Regulations of the Mined Land Reclamation Board <br />for Coal Mining, was received on May 2, 1996. <br />The application is generally complete with a couple of exceptions <br />as we have discussed. Those items pertain to the Applicant <br />Violator System and are listed below as follows: <br />1. William I. Koch is listed in the AVS as a Chief Executive <br />Officer of Oxbow Carbon and Minerals with a beginning date of <br />February 21, 1991. William Koch is not included in the <br />ownership and control list provided by the Sanborn Creek Mine. <br />The Division needs proof of William Koch's resignation in the <br />form of a resignation letter or corporate minutes. This <br />documentation is necessary to end date William Koch from the <br />AVS. <br />2. Several new officers have been included in the permit, but the <br />permit does not reflect when the positions were assumed, as <br />required under Rule 2.03.4(3)(c). Please submit beginning <br />dates for the officers of Oxbow Carbon and Minerals. <br />The Division contacted the Secretary of States Office to <br />verify the ownership and control information for Oxbow Carbon <br />and Minerals Inc. According to the records on file at the <br />States Office, numerous directors are listed that have not <br />been included in the permit pages. The following people were <br />listed as directors; <br />
