With <br />cessation of mining operations there was no longer any need to maintain the associated off- <br />site Santa Fe (SF) Loadout facilities and reclamation of this facility was completed in 1994. <br />With this submittal, Energy Fuels respectfully requests release of that portion of the Raton <br />Creek bond amount associated with the Santa Fe Loadouts. <br />The accompanying bond release application is formatted to effect compliance with applicable <br />provisions of Rule 3.03.2. in addition, the accompanying proposed public notice states Energy <br />Fuel's intent to seek bond release and is designed to meet the requirements for both <br />notification of land owners and government bodies and publication in the local newspaper. A <br />listing of those individuals and entities to receive notice is also attached. <br />Energy Fuels leased and maintained the SF Loadouts for stockpiling and loading of coal into <br />railroad cars for shipment on the on the adjoining spur. The loadout area had a long history <br />of prior use, having been used for industrial uses prior to that. Both loadout are located on <br />Santa Fe property located in the Trinidad rail yards. Consistent with previous disturbance and <br />use, and the stated desires of the landowner, the postmining land use for the SF Loadout was <br />designated as industrial. <br />
