currently operate under the terms and conditions of air permits and emission control
plans approved by the Air Pollution Control Division of the Colorado Department of
Health. The existing air permits will be used for the processing facility at Rockin'
WP-North while the particulate emissions control plan applies to both the current
milting operation and to future mining. All new processing equipment will have
appropriate air permits from the State of Colorado Air Pollution Control Division.
Over the past twenty years, particulate emissions from Lyons have been
successfully controlled using a number of measures including the following:
• Use of conveyors rather than haul vehicles to transport excavated sand and
gravel to the processing plant.
• Concurrent mining and reclamation reduce the amount of land disturbed at
any one time.
• Moistwe content of excavated sand and gravel serves to reduce process
emissions.
• Future sand and gravel washing operations produce little if any particulate
emissions.
Water Pollutiou Control
Water pollution control at the Lyons site is regulated tinder the Clean Water Act
at both the federal and state levels. Section 404 of the Clean Water Act is intended to
protect waters of the United States including wetlands. This program is administered
by the U.S. Army Corps of Engineers. At the state level, [he Water Quality Control
Division of the Colorado Department of Health regulates storm water runoff and the
national pollution dischazge elimination system (NPDES) program. Regarding storm
water runoff, the State Division of Water Quality Control has implemented a general
permit for the sand and gravel producer. Under requirements of this general permit,
Westem Mobile has produced a storm water management plan (SWMP) that is used
to minimize pollution associated with storm water runoff from their existing Lyons
operation. This SWMP will be expanded to include the property that is part of this
special use application.
The State Division of Water Quality Control also regulates water discharges from
sand and gravel mining through the NPDES program. In this case, ground water
pumped from the mining azea cannot be discharged from the property without an
approved NPDES permit. These petTrtits require the operator to periodically sample
the water that is discharged from the property and not to exceed specific pollutant
Western Mobile Lyons -Rockin' WP M-2
