<br />currently operate under the terms and conditions of air permits and emission control <br />plans approved by the Air Pollution Control Division of the Colorado Department of <br />Health. The existing air permits will be used for the processing facility at Rockin' <br />WP-North while the particulate emissions control plan applies to both the current <br />milting operation and to future mining. All new processing equipment will have <br />appropriate air permits from the State of Colorado Air Pollution Control Division. <br />Over the past twenty years, particulate emissions from Lyons have been <br />successfully controlled using a number of measures including the following: <br />• Use of conveyors rather than haul vehicles to transport excavated sand and <br />gravel to the processing plant. <br />• Concurrent mining and reclamation reduce the amount of land disturbed at <br />any one time. <br />• Moistwe content of excavated sand and gravel serves to reduce process <br />emissions. <br />• Future sand and gravel washing operations produce little if any particulate <br />emissions. <br />Water Pollutiou Control <br />Water pollution control at the Lyons site is regulated tinder the Clean Water Act <br />at both the federal and state levels. Section 404 of the Clean Water Act is intended to <br />protect waters of the United States including wetlands. This program is administered <br />by the U.S. Army Corps of Engineers. At the state level, [he Water Quality Control <br />Division of the Colorado Department of Health regulates storm water runoff and the <br />national pollution dischazge elimination system (NPDES) program. Regarding storm <br />water runoff, the State Division of Water Quality Control has implemented a general <br />permit for the sand and gravel producer. Under requirements of this general permit, <br />Westem Mobile has produced a storm water management plan (SWMP) that is used <br />to minimize pollution associated with storm water runoff from their existing Lyons <br />operation. This SWMP will be expanded to include the property that is part of this <br />special use application. <br />The State Division of Water Quality Control also regulates water discharges from <br />sand and gravel mining through the NPDES program. In this case, ground water <br />pumped from the mining azea cannot be discharged from the property without an <br />approved NPDES permit. These petTrtits require the operator to periodically sample <br />the water that is discharged from the property and not to exceed specific pollutant <br />Western Mobile Lyons -Rockin' WP M-2 <br />
