:~ <br />In regard to the request for bond reduction which was also included in your <br />recent letter, while this request is not appropriate until the mine permit is <br />revised, there are some aspects of your request that should be changed in <br />order that it be accepted when eventually filed. These changes will be <br />clearer to you if you refer to the material provided at our December meeting. <br />You application for bond reduction follows the same initial steps as <br />described for bond release and should include the information specified <br />fora bond release application on the first page of the copy of the <br />liandbook Memorandum you were provided. Only if the application contains <br />the required information will it be accepted and the inspection scheduled. <br />2. You should send notice of your request to adjoining property and surface <br />owners, appropriate local government bodies, municipalities, regional <br />planning commissions, boards of county commissioners, county planning <br />agencies, sewage and water treatment authorities, and water conservancy <br />and water conservation districts in the area prior to filino_ the <br />request. Copies of these letters and evidence o eir mai rng must be <br />s~it~ed to the Division within 30 days of the filing of the request. <br />3. Also at the time of the request for bond reduction or release, <br />publication of an advertisement of the request should be scheduled for <br />four consecutive weeks. You are required to submit evidence of that <br />publication to the Division within 30 days after the last date of <br />publication. <br />4. In addition to the information you included in the public notice <br />accompanying your letter, the notice should mention the number of acres <br />involved and the date of permit approval. Instead of listing a specific <br />date by which comments etc. must be received by the Division, your <br />advertisement should simply indicate that those comments, etc. should be <br />received by the Division within 30 days of the last publication date of <br />your advertisement. This period is set by our Rules and, unless you know <br />beforehand the date of publication, mention of a specific date is <br />misleading. <br />We will be proceeding on the renewal of the mine's permit as a Reclamation <br />Only Permit and will be expecting your proposal to modify the presently <br />approved reclamation plan in the form of a Technical Revision to the permit. <br />If you have any further questions regarding the procedure, please contact me. <br />Sincerely, <br />James C.
