:~
In regard to the request for bond reduction which was also included in your
recent letter, while this request is not appropriate until the mine permit is
revised, there are some aspects of your request that should be changed in
order that it be accepted when eventually filed. These changes will be
clearer to you if you refer to the material provided at our December meeting.
You application for bond reduction follows the same initial steps as
described for bond release and should include the information specified
fora bond release application on the first page of the copy of the
liandbook Memorandum you were provided. Only if the application contains
the required information will it be accepted and the inspection scheduled.
2. You should send notice of your request to adjoining property and surface
owners, appropriate local government bodies, municipalities, regional
planning commissions, boards of county commissioners, county planning
agencies, sewage and water treatment authorities, and water conservancy
and water conservation districts in the area prior to filino_ the
request. Copies of these letters and evidence o eir mai rng must be
s~it~ed to the Division within 30 days of the filing of the request.
3. Also at the time of the request for bond reduction or release,
publication of an advertisement of the request should be scheduled for
four consecutive weeks. You are required to submit evidence of that
publication to the Division within 30 days after the last date of
publication.
4. In addition to the information you included in the public notice
accompanying your letter, the notice should mention the number of acres
involved and the date of permit approval. Instead of listing a specific
date by which comments etc. must be received by the Division, your
advertisement should simply indicate that those comments, etc. should be
received by the Division within 30 days of the last publication date of
your advertisement. This period is set by our Rules and, unless you know
beforehand the date of publication, mention of a specific date is
misleading.
We will be proceeding on the renewal of the mine's permit as a Reclamation
Only Permit and will be expecting your proposal to modify the presently
approved reclamation plan in the form of a Technical Revision to the permit.
If you have any further questions regarding the procedure, please contact me.
Sincerely,
James C. Stevens
Senior Reclamation Specialist
JCS/scg
Enclosure(s)
2817E
