Peter Matt hi es <br />New Castle Energy Corp. <br />9137 East Mineral Circle <br />Englewood, Colorado 80112 <br />RE: Newcastle Mine (Permit C-84-065) Permit Renewal, Reclamation Plan <br />Modification, Bond Reduction. <br />Dear Mr. Matthies: <br />The Division is in receipt of your letter of January 17, 1989 regarding the <br />renewal application and request for bond reduction for the Newcastle Mine. <br />Since Candy Thompson is leaving the Division and your mine will be lacking a <br />lead specialist, I am responding to your letter and will serve as your contact <br />with the Division for the time being. <br />The Division acknowledges your request fora Reclamation Only Permit for the <br />Newcastle Mine and twill proceed with the renewal on that basis. That should <br />simplify the process considerably. <br />In regard to your request fora reduction of the reclamation bond, apparently <br />you misunderstood the necessary sequence of events described to you in our <br />meeting on December 9, 1988. The first step you must take toward securing the <br />bond reduction is to modify the reclamation plan to reflect the lesser degree <br />of disturbance. You do this by proposing the modification in the form of a <br />Technical Revision to the permit. <br />Once this revision is approved and a cost of the new reclamation plan agreed <br />upon, then you may apply fora bond reduction. When that process is completed <br />and a new bond is posted, you could conceivably proceed with the reclamation <br />and upon completion of the backfilling and grading, then apply fora Phase 1 <br />release of up to 60% of the new bond. The procedures for requesting both the <br />initial bond reduction and ultimately the Phase 1 bond release are much the <br />same and are described in the material ,you were provided at our December <br />meeting. <br />You can see from the preceding description, you are premature in publishing <br />and notifying the appropriate individuals and government bodies of your <br />request fora bond reduction. You have not applied for and secured the <br />necessary approval of a technical revision to the permit modifying the <br />reclamation plan.
