These are surface diversion structures from draws and not from ground <br />water interception. <br />The Referee does therefore conclude that the above entitled Application <br />should be granted and that said amounts of water per second of time with <br />Appropriation dates of December Z3, 1991 are hereby awarded conditionally to <br />Parkerson Diversion No. 1 and No. 2, respectively for those uses specified in <br />paragraph 6 above, provided always that said amounts of water are on the <br />condition that said quantities of water be diverted and applied to beneficial <br />use within a reasonable time; SUBJECT, HOWEVER, TO ALL EARLIER PRIORITY RIGHTS <br />OF OTHEP,S and to the integration an to a a n on y t e ivision Engineer c <br />suc~pr orities and changes of rights in accordance with law. <br />Application for a Finding of Reasonable Diligence shall be filed in the <br />same month as the decree herein is entered every six years after the entry of <br />the decree herein so long as applicant desires to maintain the conditional <br />water rights herein awarded, or until a determination has been made that such <br />conditional rights are made absolute by reason of the completion of the <br />appropriation, or are otherwise disposed of. <br />It is accordingly ORDERED that this Ruling shall be filed with the Water <br />Clerk subject to Judicial review. <br />It is further ORDERED that a copy of this Ruling shall be filed with the <br />appropriate Division Engineer and the State Engineer. <br />Dated /YIs,-tic, ~py~ <br /> <br />~,~ ~ 3-9~ <br />~~~r~~~ <br />BY THE REFEREE: <br />!/ ..~ ~ u/--~ <br />aTT e#~r eferee <br />Water Division No. 5 <br />State of Colorado <br />No protest was filed in this matter.
