<br />DISTRICT COURT, WATER DIVISION N0. 5, COLORADO <br />---------------------------------------------- <br />Application No. 91CW271 <br />---------------------------------------------- <br />RULING OF REFEREE <br />IN THE MATTER OF THE APPLICATION FOR WATER RIGHTS OF A. & G. PARTNERSHIP, IN <br />THE COLORADO RIVER, OR ITS TRIBUTARIES, TRIBUTARY INVOLVED: UNNAI.IED, IN MESA <br />COUNTY <br />------------------------------------------------------------------------------- <br />The above entitled Application was filed on December 31, 1991, and was <br />referred to the undersigned as Water Referee for Water Division No. 5, State <br />of Colorado, by the Water Judge of said Court on the 9th day of January, 1992, <br />in accordance with Article 92 of Chapter 37, Colorado Revised Statutes 1973, <br />known as The Water Right Determination and Administration Act of 1969. <br />And the undersigned Referee having made such investigations as are <br />necessary to determine whether or not the statements in the Application are <br />true and having become fully advised with respect to the subject matter of the <br />Application does hereby make the following determination and Ruling as the <br />Referee in this matter, to wit: <br />The statements in the Application are true. <br />2. The names of the structures involved are Parkerson Diversions No. 1 <br />and 2. <br />3. The name and address of the Claimant: A & G Partnership; c/o Alan <br />Parkerson; 3324 E-1/4 Road; Clifton, CO 81520. <br />4. The source of the water is from unnamed draws tributary to the <br />Colorado River. <br />5. a) The point of diversion of Parkerson Diversion No. 1 is at a <br />point 1090 feet West and 90 feet North of the SE Corner of the N1/25W1/4 Sec. <br />23, T. 1 S., R. 1 E., Ute P.M. <br />b) The point of diversion of Parkerson Diversion No. 2 is at a <br />point 500 feet East and 100 feet South of the SW Corner of the NW1/4SW1/4 Sec. <br />23, T. 1 S., R. 1 E., Ute P.M. <br />6. The use of the water for both structures is irrigation; stock <br />watering; and dust control, gravel washing and moisture control of gravel, all <br />in connection with the mining of gravel. <br />7. The date of .initiation of Appropriation for both structures is <br />December 23, 1991. <br />8. The amount of water claimed is 0.50 c.f.s. and 1.0 c:f.s., <br />conditional for Parkerson Diversion No. 1 and No. 2, respectively. <br /> <br />
