1 ~ • s <br />r <br />1 A. GJP shall pay Bradburys an advance royalty of $5,000.00 upon execution of <br />1 this lease. <br />B, The advance royalty payable hereunder shall be offset against royalties which <br />1 shall accrue and be payable to Bradburys for product mined and removed from the Property <br />under this lease. If any excess advance royalty remains at the end of the term or other <br />termination of this lease, Bradburys shall be entitled to retain such excess royalty, and shall <br />1 not be required to refund the excess to GJP. <br />8. Bradburys warrant title to the Property and to all sand and gravel located on the <br />1 Property, and further warrant and covenant that GTP shall have the right to extract sand and gravel <br />1 from the Property and otherwise use and occupy the Property as set forth in this lease without <br />interference from any person. This warranty does not apply to any permit cond'+tions or other <br />governmental conditions or approvals that GJP must have or meet to conduct its operations on the <br />Property under this lease, compliance with which are GJP's sole obligation and responsibility. <br />' 9. Bradburys shall pay all real property taxes and special assessments relating to~the <br />Property which may be unposed or incurred during the term of this lease. G1P shall pay all personal <br />property taxes and any and all inventory taxes which may be imposed or incurred during the term of <br />1 this lease, and all costs and expenses relating to compliance with any permit conditions or other <br />governmental conditions or approvals that GJP must have or meet to conduct its operations on the <br />1 Property under this lease. <br />1 10. GJP shat! pay all charges for electricity, gas, water and utilities furnished or supplied <br />to or on any part of the Property. <br />1 11.
