1 <br /> <br />' equipment used in connection with the extracting, hauling, processing, and stockpiling of the sand <br />and gravel and related products (such purposes being referred to herein as "mining purposes"). GJP <br />shall have the exclusive right to the Property during the term of this tease for mining purposes, and <br />neither Bradburys nor any other party shall have the right to use or occupy the Property for mining <br />purposes during the term of this lease. However, Bradburys shall be entitled to enter upon and use <br />t the Property for purposes other than mining purposes, to the extent that such entry and use does not <br />unreasonably interfere with GJP's use of the Property for mining purposes under this Lease. <br />I~ <br />2. GJP may realign any existing roadways on the Property, and create other roads on the <br />' Property, as necessary for its operations. GJP agrees to keep the haul road utilized by it in a <br />reasonably dust free condition. In planning its mining activities on the Property, GJP shall consult <br />with Bradburys in order to develop a layout of the pit area which will be satisfactory to Bradburys. <br />' GJP shall also consult with Bradburys in developing a reclamation plan for the Property. Bradburys <br />,I , agree that any layout of the pit area must be such that it will allow G7P to economically mine sand <br />and gravel from the Property, and that any reclamation plan developed for the Property must be <br />' economically feasible and generally consistent with reclamation plans adopted for other similar pits <br />ur the Mesa County area. Prior to commencement of actual mining activities on the Property, GJP <br />shall construct a fence on the portion of the Property located east of I-Iighway 50, in a location <br />specified by Bradburys, to separate the portion of the Property which will be actively used by GTP <br />in connection with its mining activities (including without limitation the area to be mined, staging <br />azeas, stockpiling azeas and areas for equipment} from the remainder of the Bradbury's property.
