<br />1 <br />' LEASE AGREEMENT <br />' THIS LEASE AGREEMENT is made and executed effective the 4~~'` day of l't ~~'h <br />' 1998, between Walter D. Bradbury and M.P. Bradbury, whose address for purposes of this <br />' Agreement is Whitewater, CO 8152"7 ("Bradburys"), and Grand Junction Concrete Pipe Company, <br />doing business as Grand ]unction Pipe & Supply Company, a Colorado Corporation, whose address <br />~,' for purposes of this Agreement is P. O. Box 1849, Grand Junction, Colorado 81502 ("GJP"). <br />' RECITALS <br />A. Bradburys are the owners of real property, including all interest in the sand, gravel, <br />and mineral rights, located in Mesa County, Colorado, described as follows: <br />I' TheNl/2 SEl/4, Section 5, T. 3 S., R. 2 E., Ute Meridian; the N1/2 SWl/4 and the <br />NI/2 SE1/4, Section 4, T. 3 S., R. 2 E., Ute Meridian; and that portion of the SI/2 <br />NWl/4 and the Sl/2 NE1/4, Section 4, T. 3 S., R. 2 E., Ute Meridian, lying South <br />' of the Smith Ditch; all in Mesa County, Colorado. <br />(the "Property"). The Property is shown on the map attached hereto as Exhibit A. <br />' B. The parties desire to enter into this lease for the purpose of allowing GJP to extract <br />I' sand and gravel and related products from the Property, and to utilize the remaining portions of the <br />' Property, on the terms and conditions set forth below. <br />AGREEMENT <br />1.
