<br />43.2 <br />"Leachate" means any liquid, including any suspended or dissolved compo- <br />• nents in the liquid, that has percolated through or drained from the <br />byproduct material. <br />"Licensed site" means the area contained within the boundary of a location <br />under the control of persons generating or storing byproduct materials <br />under a license. <br />"Liner" means a continuous layer of natural or man-made materials, beneath <br />or on the sides of a surface impoundment which restricts the downward <br />or lateral escape of byproduct material, hazardous constituents, or <br />Leachate. <br />"Maximum credible earthquake" means that earthquake which would cause the <br />maximum vibratory ground motion based upon an evaluation of earthquake <br />potential considering the regional and local geology and seismology <br />and specific characteristics of local subsurface material. <br />"Point of compliance" is the site-specific location in the uppermost <br />aquifer where the groundwater protection standard must be met. The <br />objective in selecting the point of compliance is to provide the <br />earliest practicable warning that an impoundment is releasing <br />hazardous constituents to the groundwater. The point of compliance is <br />selected to provide prompt indication of groundwater contamination on <br />the hydraulically downgradient edge of the disposal area. <br />• "Rule" is as defined in The Administrative Procedure and Texas Register <br />Act, Article 6252-13a, V.T. C. S., as amended. The word "rule" was <br />formerly referred to as "regulation." "Rule" means any agency state- <br />ment of general applicability that implements, interprets, or <br />prescribes law or policy, or describes the procedure or practice <br />requirements of an agency. The term includes the amendment or repeal <br />of a prior rule but does not include statements concerning only the <br />internal management or organization of any agency and not affecting <br />private rights or procedures. <br />"Security" means: <br />(1) cash deposits; <br />(2) surety bonds; <br />(3) certificates of deposit; <br />(4) deposits of government securities; <br />(5) irrevocable letters of credit; or <br />(6) other security acceptable to the elgency. <br />"Surface impoundment" means a natural topographic depression, man-made <br />excavation, or diked area, which is designed to hold an accumulation <br />of liquid wastes or wastes containing free Liquids, and which is not <br />an injection well. <br />"Uppermost aquifer" means the geologic formation nearest the natural ground <br />surface that is an aquifer, as well as lower aquifers that are <br />• hydraulically interconnected with this aquifer within the facility's <br />property boundary. <br />43 - 3 (April 1990) <br />
