<br />43.32(d)(2) <br /> <br />(2) If no radiation attributable to activities conducted under the <br />license is detected, the licensee shall submit a certification • <br />that no detectable radioactive contamination of the location(s) <br />was found. <br />(3) If the information submitted is adequate and meets the appro- <br />priate limits in 21.108, 21.109, and 43.90(1), the Agency will <br />notify the licensee in writing that the license is terminated. <br />(4) If radiation levels or radioactive material in excess of the <br />limits of 21.108, 21.109, or 43.90(1) are found, the license <br />continues in effect beyond the expiration date, if necessary, <br />with respect to possession of residual radioactive material until <br />the Agency notifies the licensee in writing that the license is <br />terminated. During this time, the licensee is subject to the <br />provisions of 43.32(e). In addition to the information submitted <br />under 43.32(d)(1)(iii), the Licecisee shall submit a plan, as <br />appropriate, for decontaminating the location(s). <br />(e) Each licensee who possesses residual radioactive material under para- <br />graph (d)(4) of this section, following the expiration date specified <br />in the license, shall: <br />(1) be limited to actions, involving radioactive material, related to <br />preparing the location(s) for release for unrestricted use; and <br />(2) continue to control entry to restricted areas until the loca- • <br />tion(s) are suitable for release for unrestricted use and the <br />Agency notifies the licensee in writing that the license is <br />terminated. <br />(f) Each licensee shall submit to the Agency all records required by <br />21.401Cf) before the license is terminated. <br />43.33 Renewal of License <br />(a) Application for renewal of specific licenses shall be filed in <br />accordance with 43.24. <br />(b) In any case in which a licensee, not less than 90 days prior to <br />expiration of his existing license, has filed an application in proper <br />form for renewal or for a new license authorizing the same activities, <br />such existing license shall not expire until the application has been <br />finally determined by the Agency. <br />Amendment of Licenses at Request of Licensee <br />Applications for amendment of a license shall be filed in accordance with <br />43.24, except that the requirements of 43.24(a), (g), and (h) may be waived <br />at the discretion of the Agency. Such applications shall also specify how <br />the licensee desires the license to be amended and the basis for such • <br />amendment. <br />43 - 10 (April 1990) <br />
