<br />Rule 4.03.1 "Haul Roads", subsection (7) states: <br />"(7) Reclamation <br />(a) Unless the Division a roves retention of haul <br />roads as suitable or tea rove ostminin an use, <br />imme late y a ter t e roa is no onger nee a or operations, <br />reclamation, or monitoring: <br />(i) The road shall be closed to vehicular <br />traffic; <br />(ii) The natural-drainage patterns shall be <br />restored; <br />(iii) All bridges and culverts shall be removed; <br />(iv) Roadbeds shall be ripped, plowed, and <br />scarified; <br />(v) Fill slopes shall be rounded or reduced <br />and shaped to conform the site to adjacent terrain and to meet <br />natural-drainage restoration standards; <br />(vi) Cut slopes shall be shaped to blend with <br />the natural contour; <br />(vii) Terraces shall be constructed as necessary <br />to prevent excessive erosion and to provide long-term stability in <br />cut-and-fill slopes; and <br />(viii) The regraded area shall be covered with <br />topsoil in accordance with 4.06.4(2) and revegetated in accordance <br />with 4.15. <br />(b) Unless otherwise authorized by the Division, all <br />road-surfacing materials shall be removed, hauled or conveyed, and <br />disposed under 4.11.4." <br />Rule 2.05.5 "Postmining Land Uses" subsection (1) "Surface Coal Mining <br />Activities" states: <br />(a) Each plan shall contain a detailed narrative of <br />the proposed use, following reclamation of the land within the <br />proposed permit area. In accordance with land use categories <br />established in the narrative, the plan shall include a discussion <br />of the utility and capacity of the reclaimed land to support a <br />variety of alternative uses, and the relationship of the proposed <br />use to existing land use policies and plans. This description <br />shall explain: <br />(i) How the proposed postmining land use is to <br />be achieved and the necessary support activities which may be <br />needed to achieve the proposed land use; <br />(ii) Where a land use different form the <br />premining land use is proposed, alt materials needed for approval <br />of the alternative use under 4.16; <br />(iii) The consideration which has beengiven to <br />making all of the nrooosed~ace- co mining an~recl-amation <br />o eratlons consistent with surface owner Tans antl rograms; antl <br />T e escription s a a accompame y a copy <br />of the comments concerning the proposed use by the legal or <br />equitable owner of record of the surface of the proposed permit <br />area and the State and local government agencies which would have <br />to initiate, implement, approve, or authorize the proposed use of <br />the land following reclamation. <br />(c) A map prepared to the standards of 2.10 shall <br />accompany the plan." <br />
