Pursuant to your request, I have completed a review of Cyprus - Yampa Valley
Coal's request to retain many of its haul and access roads permanently within
the Eckman Park mine arid. In response to our earlier adequacy comments
issued during permit renewal processing, the operator has proposed tD reduce
the tracking surface width by scarifying and reseeding grasses. The operator
proposes to retain the majority of the embankments and cut slopes in their
operational form. These roads involve cut slopes and embankments of up to
80 feet in height, roadbeds of greater than 50 feet in width, and culverts of
up to 60 inches in diameter, all of which are proposed to be permanently
retained as components of the post-mined reclaimed landscape. In order to
unsure a clear perception of actual site conditions, I also conducted an
inspection of the site on Friday, August 21st, in the company of Mr. Terrell
Johnson of C-riCC's staff.
Applicable Regulations
Several of our regulations apply to this situation. I have added underlining
for emphasis. Rule 4.12.2 "General Grading Requirements" states:
"(1) The final graded slopes shall not exceed in grade
either the approximate premining slopes, or any lesser slopes
approved by the Division based on consideration of soil, climate,
or other characteristics of the surrounding area. Postmining
final graded slopes need not be uniform but shall approximate the
Rule 4.03.1 "Haul Roads", subsection (1) "General Requirements" states:
